If you are using the I-9 Center as a stage in your Fountain Hire application, the applicant can complete Section 1 of the I-9 form with expired PRC, I-94, or EAD documents. If this occurs, the worker must provide you with a valid extension document to prove work authorization after hire. This will require user action in the I-9 Center to request the extension document from the worker. This scenario will only apply if the I-9 form is assigned to the worker prior to hire.
What is the difference between requesting extension documents and reverifications?
Reverifications occur when an applicant or worker’s Section 1 documents expire after they have been hired.
Requesting extension documents occurs when an applicant completes Section 1 with already expired documents prior to their hire date.
Knowing There Are Expired Documents
You will know the worker submitted expired PRC, I-94, or EAD documents in two ways:
If your company has an Authorized Representative completing Section 2 for the applicant, they may reject the documents during their review due them being expired. These workers will be found in the Section 1 tab of the I-9 Forms Table because Section 2 was not successfully completed.
If your company is using E-Verify, the worker’s E-Verify case status will come back as Unconfirmed Data because the documents have expired.
You can also use the quick Filter by Status buttons related to extension documents in the Expiring tab of the I-9 Forms table.
Required User Action
You must request a valid extension document from the worker by clicking on either the 3 dot button to the right of their name in the I-9 Forms table or the More Actions button in the Manage screen for the worker. Then click Request extension documents in the dropdown, and click Send request in the confirmation pop-up. This option will only be available for workers who have expired PRC, I-94, or EAD documents.
The worker will move into the Expiring status tab on the I-9 Forms table.
Worker Experience
Once this request has been sent, the worker will receive an email notification and see a new task in their Worker Portal, where they will indicate if they have extension documents or not via an I-797C (Notice of Action form).
If they indicate they do not have extension documents, they will be warned that they may not be able to continue employment with the company.
If they indicate they do have extension documents, they will be required to upload them to the task. They can upload up to five documents.
Reviewing Submitted Extension Documents
To receive email notifications when a worker submits extension documents, turn on Daily Digest notifications by clicking on your company logo in the bottom left corner and then Profile in the menu. Scroll down to the I-9 Center section and toggle on the Extended authorization document and the Document to review toggles.
Extension documents are reviewed in the worker’s I-9 Forms Manage screen by clicking on Review extension doc button in the top right corner.
You will choose to either Approve or Reject the extension. Click Confirm decision to finish.
The worker will be notified via email of your decision. If you have rejected the documents, the task will be reset, and the worker will have another opportunity to upload valid extension documents.
Important Note:
The worker should provide you with the new, unexpired documents when received. They will have a specific timeframe to supply these documents to you. Review more about Extension Document procedures, including timeframes, on the USCIS website.
